Terms of Service

These terms apply to the use of the Pulse by MMTC iPhone app (“App”), the website pulsebymmtc.com and related services (together “Pulse”), provided by Manuel Eggers, Kammerbotenstraße 1, 83435 Bad Reichenhall, Germany (“we”, “us”). By using Pulse you agree to these terms. For apps obtained from the Apple App Store, Apple’s Standard Licensed Application End User License Agreement applies in addition.

1. The service

Pulse provides crypto market information: prices, estimated liquidation levels (heatmap), market regime scores, news, macro events, alerts and tools to record your own trades. Pulse is an information and journaling tool. We do not execute trades, hold funds or manage assets.

No financial advice. All content is for general information only and does not constitute investment, financial, legal or tax advice or a recommendation to buy or sell any asset. Liquidation levels, scores and signals are model estimates based on public exchange data and may be inaccurate, delayed or incomplete. Trading crypto assets and derivatives is highly risky and can lead to the total loss of your capital. You are solely responsible for your decisions.

2. Eligibility and account

You must be at least 18 years old. Some features require an account via Sign in with Apple. Keep your device and account secure. You are responsible for the accuracy of the data you enter.

3. Subscriptions and purchases

Some features may be offered as paid subscriptions or one-time purchases through the Apple App Store. Prices are shown in the App before purchase. Payment, renewal, cancellation and refunds are handled by Apple under Apple’s terms; subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period in your Apple ID settings. Statutory consumer rights remain unaffected.

4. Exchange connections

If you connect an exchange account, only use API keys with read-only permissions. We use the key solely to import your trade history. You can disconnect at any time. We are not responsible for the availability or correctness of data provided by exchanges.

5. Acceptable use

You may not misuse Pulse, in particular: interfere with or overload our systems, access them by automated means beyond normal use, reverse-engineer the App except where permitted by law, resell or redistribute our data or content, or use Pulse for unlawful purposes.

6. Intellectual property

The App, website, designs, texts, graphics and data compilations are protected by copyright. You receive a personal, non-exclusive, non-transferable right to use Pulse for your own purposes. Market data remains subject to the rights of its respective sources.

7. Availability and changes

We strive for high availability but cannot guarantee uninterrupted service. Market data depends on third-party sources. We may change, extend or discontinue features where reasonable for you, e.g. for technical, legal or security reasons.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given. For slight negligence we are only liable for breach of an essential contractual obligation (an obligation whose fulfilment makes proper performance possible and on which you may regularly rely), limited to the foreseeable damage typical for this type of contract. Otherwise our liability is excluded. In particular we are not liable for trading losses resulting from decisions based on information in Pulse.

9. Termination

You can stop using Pulse and delete your account at any time in the App. We may suspend or terminate access in case of serious breaches of these terms. Paid subscriptions are governed by Apple’s terms.

10. Privacy

How we process personal data is described in our Privacy Policy.

11. Changes to these terms

We may amend these terms for valid reasons (e.g. new features or legal changes). We will inform you of material changes in the App or on this page in good time. If you continue to use Pulse after the changes take effect, the new terms apply; you may object and stop using Pulse.

12. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. Should any provision be invalid, the remaining provisions remain unaffected.
